See below that was sent to Laura this morning.

 

I am in Dubai until Wednesday 1st but will still keep all communication lines open via email and phone.

 

As soon as I have an update I will share.

 

What I would say is this David - there is nothing my end stopping this transaction happening. Providing the formalities are done correctly and all due diligence has taken place it can then happen.

 

I fully understand it’s taken longer than we both had ever hoped but I simply can’t promise that the 31st deadline will be met, especially if Laura is still awaiting docs for whatever reason.

Earlier this year it was verbally stated this should happen by end of July and then end of September.  If Priors are

still intent on proceeding I believe the time has come when we need to agree a deadline to exchange and suggest

this should be the end of this October with completion by the end of November.

 

This delay is restricting the granting of a straightforward option on either the 4acres or the whole 5 acre site.

I do believe we have been extremely understanding and worked with Priors by not pushing for an earlier sale.

  1. Draft contract for your approval
  2. Plan 2358-00C (this plan will form the contract and transfer plan)
  3. OCE and Filed plan of title NK322379
  4. Agreement dated 13-12-2004 referred to in title NK322379
  5. Planning Permission referred to in the contract (which your client obtained and will build out) with accompanying plans
  6. Option to Tax, my client has taken the Vat election for this land.

 

Replies to CPSE 7 and the draft Transfer will follow shortly, I have been asked to highlight the boundaries in plan marked “2358-25D Proposed Site Plan and Site Section”. The proposed hedgerow forming the outer boundary of the Property is within the red line plan. My client is most insistent no large trees are planted that could overhang the boundary, thus why the Property boundaries have been set out as a fence and outer hedgerow on the plans. Your client will be expected to create the boundary as per plan 2358-25D Proposed Site Plan and Site Section. The Transfer will contain restrictions relating the boundary height, these are referred to in clause 11 of the contract.
